Level 3 sex offender resides in Stoneham

STONEHAM, MA - The Stoneham Police Department was notified late last week that a convicted level 3 sex offender resides in town.
Under the state sex offender registration law, the town is notified when a level 3 offender--the highest class--either resides or works in the community. According to Stoneham Police Chief Eugene Passaro, level 3 sex offenders are the "most likely to commit a crime again."
The Police Department is now required to release this information to the local media, schools and other youth organizations in the town.
According to the information provided by the department, the level 3 sex offender is Brian Nagle, 32, of 99 Franklin Street, Apt. 1.
Nagle has been convicted six times from 1987-1996 for either open and gross lewdness or indecent assault and battery on a child.
On two separate occasions in February of 1987, Nagle was reportedly convicted on seven counts of open and gross lewdness. In December of 1989, he was convicted of indecent assault and battery on a child under the age of 14, according to police documents.
In 1990, he was twice convicted of open and gross lewdness and in October of 1996, he was convicted of indecent assault and battery on a child, records show.
When Nagle registered as a sex offender, he provided a work address as Guest Street in Brighton.
Nagle is one of 11 Stoneham sex offenders who have been required to register in the community where they live and work. Of those 11, Stoneham Police Lt. Greg O'Keefe said 8-9 live in Stoneham.
Passaro said the new law has been criticized since only 6,000 of the estimated 14,000 convicted sex offenders in the state have actually registered.
O'Keefe said that Nagle had been informed that he would be classified as a level 3 offender and had the right to appeal that decision, but declined to file an appeal.
The list of local registered sex offenders can be obtained at the Police Department after filling out the necessary application. The application notes that anyone who uses the sex offenders' information to threaten or commit a crime, may be punished by a fine or imprisonment.
