Board of Health deals with issues

STONEHAM, MA - The Board of Health covered a lot of ground last week as it continues to monitor the various factions of its jurisdiction with the help of Health Agent Lou-Ann Clement.
At Tuesday night's meeting, the board voted unanimously to grant a license to massage therapist Marie Mandarano for her performance of massage for muscular therapy. Mandarano's practice will be located in the office of Certified Nurse Mid-wife Karyl Cargill, at the Boston Regional Medical Center.
According to Mandarano, her practice will involve chair massage with patients who are fully dressed. Massage to the back, shoulders, arms, neck and, at the client's request, head will be performed.
Universal procedures regarding cleaning, sterilization and hand washing will be followed, she assured.
One outstanding issue regarding Mandarano's license was whether or not Cargill's office would incur a fee for acting as the practice's establishment.
"In order to be an operator, you need to have an establishment to be licensed out of," stated Chairman Michael Rolli.
Board member Ben DiRusso stated that the board would have no problem granting the license since Mandarano has complied with all requirements, but that the issue regarding the establishment did need clarification.
Clement will be performing an inspection of the premises and the approval is conditional on her recommendation.
In other Board of Health news, the board granted a variance for installing a bathroom on the second floor of a structure being constructed on Franklin Street.
Frank Walsh, owner of Walsh Landscaping, is building a structure at 49-59 Franklin Street for office space and storage of vehicles and equipment for his landscaping business. Walsh has already received an approved site plan from the Board of Selectmen for the facility that will house an office on the second floor with a first floor garage and storage area. The bathroom originally stipulated on the plan for the second floor is not needed, according to Walsh, since the building will not be used by customers.
"This is just for me and my workers," stated Walsh.
In addition, Walsh requested a waiver to the requirement for making the first floor bathroom handicap accessible since, again, no public access will be allowed.
"I looked at the area...You've made some remarkable improvements ... over what was there...I have no qualms," Rolli stated.
The board voted unanimously to waive the requirement for a second floor bathroom along with handicap accessibility requirement for the one on the first floor . The motion stipulated that the building would be for the company's use only.
A public hearing regarding the request of Ralph Wallace, in response to neighbors' complaints regarding the condition of Wallace's yard, also held on Tuesday night, resulted in agreement by Wallace to invite the board to visit his property once it supplied him with the names of people who registered the complaint.
"Your actions weren't becoming of a town official," Wallace told Clement, who he alleges came on his property and took pictures of his yard. Clement stated that she took pictures of the yard from the sidewalk in addition to one picture of an oil tank which she took as she walked to his front door.
Clement advised that the nature of the complaints concerned the overall condition of Wallace's yard which she witnessed as containing pipes, wood, tires and a tarp. In addition, the picture of the oil tank was taken because oil is a hazardous material.
"We're here to help the public, not crucify you," stated board member Lou Golini.
The board could not immediately provide Wallace with the information he requested since the complaints did not go directly to the Board of Health. It did, however manage to get Wallace to agree to a visit once that information could be provided.
"I have the right to confront my accusers...I don't have the best of health and neither does my wife. We don't need this aggravation," Wallace said.
DiRusso assured Wallace that the board would work with him on the matter.
